Terms and Conditions

We appreciate your choice of Super Yates, a company dedicated to offering exclusive nautical experiences in Mexico’s most select destinations.
To ensure the quality, safety, and transparency of our services, the following terms and conditions apply to all reservations.

1. Reservations and Payments
A 50% deposit of the total service cost is required to confirm your reservation.
The deposit guarantees the availability of the vessel and covers operational costs prior to departure.
The remaining balance must be paid before boarding.
If full payment is not received within the established timeframe, the reservation may be cancelled without a refund of the deposit.

2. Cancellation and Rescheduling Policies
The deposit is non-refundable under any circumstances.
To request a rescheduling, you must notify us at least 5 days in advance, subject to availability.
Date changes will incur a penalty of 30% of the deposit unless a verified medical reason or force majeure applies (such as a navigation closure ordered by the Port Authority).
If notice is given less than 3 days in advance, the deposit will be forfeited.

3. Transfer of Reservation Holder
The client may transfer their reservation to another person by notifying us at least 7 hours in advance.
The new holder automatically accepts all terms and conditions stated herein.

4. Definition of Service Time
The contracted hours include all service time, which covers: navigation, anchoring, use of water toys, and onboard activities.
If the vessel includes an hour of anchoring or bay stay, that hour is part of the total contracted time, whether or not it was mentioned by the assigned salesperson.
Service time begins at the agreed boarding time, regardless of the client’s punctuality.
If the client or their group arrives late, the lost time will not be replaced or compensated.

5. Cancellations Due to Force Majeure
In the event of a navigation closure mandated by the Port Authority or another authority, the experience may be rescheduled or a credit issued for future use.
Personal delays, no-shows, or changes in client plans will not be considered force majeure.

6. Refunds
Once the service has begun, no partial or total refunds will be issued.
There will be no refund if the client chooses to end the service before the contracted time.
Clients who make partial use of the service (navigation, anchoring, food, beverages, water toys) will be considered full users of the service.

7. Client Responsibility
The client agrees to take care of the vessel, its furnishings, and all equipment onboard.
Any loss, damage, or misplacement of items (such as glasses, snorkels, inflatables, etc.) will be charged according to the vessel’s official inventory.
In the event of damage to motorized equipment or water toys (such as jetskis, seabobs, paddleboards, etc.), the client must cover the full cost of repair or replacement.

8. Conduct and Safety
Following crew instructions is mandatory.
Physical or verbal violence, illegal drug use, or excessive alcohol consumption that jeopardizes safety is strictly prohibited.
Any inappropriate behavior among passengers or toward the crew grants the captain the authority to suspend the service without refund.

9. Privacy and Data Use
Super Yates protects the privacy of all clients and complies with the Federal Law on Protection of Personal Data.
The information provided will be used exclusively for administrative, reservation, and customer service purposes.

10. Transfers and Access to Beach Clubs
Some beach clubs or private beaches only allow access via smaller boats (pangas) from a certain distance. For safety and regulatory reasons, some Super Yates vessels cannot approach the shore directly.
In these cases, the transfer will be operated by pangas belonging to the beach club or by third parties not affiliated with Super Yates. Super Yates is not responsible for incidents, delays, damages, or accidents that occur during such transfers.
The cost of the panga or additional transportation is not included in the contracted rate and must be covered directly by the client.

11. Acceptance of Conditions
By making a reservation with Super Yates, the client expressly accepts these terms and conditions in full.
We appreciate your understanding and trust in Super Yates. We look forward to serving you and providing a unique and memorable experience at sea.

Nonconformity and Claims Clause
At Super Yates, our priority is to provide exceptional nautical experiences.
If during the service or upon completion of the experience the client has any concern or comment, it must be communicated in writing to:

All concerns will be reviewed individually in order to seek a fair solution or compensation, provided the situation warrants it and proper documentation is presented.
However, once the service has been used in its entirety —including all contracted hours, activities, food, beverages, or use of onboard equipment— no total or partial refund will be issued, without exception.

Super Yates reserves the right to offer courtesy alternatives or future credit solely as a goodwill gesture, without implying acknowledgment of liability.
